There is a simple, intuitive theory of the semantic reference of proper names that has been unjustly neglected. This is the view that semantic reference is conventionalized speakers reference, i.e. the view that a name semantically refers to an object if, and only if, there exists a convention to use the name to speaker-refer to that object. The theory can be found in works dealing primarily with other issues (e.g. Stine in Philos Stud 33:319–337, 1977; Schiffer in Erkenntnis 13:171–206, 1978; (...) Sainsbury in Erkenntnis 80:195–214, 2015; Sainsbury, Thinking about things, Oxford University Press, 2018), yet these authors provide no sustained discussion of it. Devitt (Designation, Columbia University Press, 1981) did formulate a view on which semantic reference is conventionalized speaker’s reference, yet his views are assimilated to causalist views. This is a mistake. While the conventionalized speaker’s reference view captures much of what is plausible in descriptivism and causalism, it remains distinct from both. (shrink)

Kripke (1977) views Donnellan's (1966) misdescription cases as cases where semantic reference and speaker's reference come apart. Such cases, however, are also cases where semantic reference conflicts with a distinct species of reference I call "public reference", i.e. the object that the cues publicly available at the time of utterance indicate is the speaker's referent of the utterance. This raises the question: do the misdescription cases trade on the distinction between semantic reference and speaker's reference, or the distinction between semantic (...) reference and public reference? I argue that Kripke's own construal in terms of semantic reference and speaker's reference is at best incomplete, and probably wrong. This paper argues, based on Lewis’ claim that communication is a coordination game (Lewis in Minnesota studies in the philosophy of science, University of Minnesota Press, Minneapolis, pp 3–35, 1975), that we can account for the communicative function of demonstratives without assuming that they semantically refer. The appeal of such a game theoretical version of the case for non-referentialism is that the communicative role of demonstratives can be accounted for without entering the cul de sac of trying to construct conventions (...) of ever-increasing complexity. Instead communication via demonstratives is explained with reference to the general, non-domain specific ability of human beings to solve games of coordination. Furthermore, there is empirical support for such a view. Judgments concerning demonstrative reference have been shown to be sensitive to judgments concerning common ground (Clark et al. in J Verb Learn Verb Behav 22:245–258, 1983), which is exactly what the non-referentialist account would predict. The game theoretical account also allows for an intuitively plausible, non-referentialist treatment of Speaks’ ‘trumping argument’ (Speaks in Philos Stud 174:709–734, 2017), as well as the Carnap/Agnew puzzle (Kaplan in Syntax Semant 9:221–43, 1970). The achievements of the textile industry in Roman Britain are often underestimated as a result of the meagreness of our available evidence. The Edict on maximum prices issued by Diocletian in A.D. 301 shows that British capes commanded high prices on the markets of the Empire, and that in the late third century A.D. British rugs were the best in the world. In view of the competition from the traditional centres of rug manufacture in the East, this is an astonishing (...) achievement. (shrink)

The received translation and interpretation of many of the technical terms current in the textile industry of the Roman Empire are inaccurate, because lexicographers have either fought shy of being precise, or have thought that they recognized in the ancient world technical processes which originated at a much later date. The evidence is often equivocal or insufficient, but may still yield details that have been overlooked. The textile expression scutulatus, to take an example, deserves more attention than Blümner has devoted (...) to it. When it refers to the appearance of a garment, Lewis and Short, s.v. scutulatus, translate ‘diamond or lozenge-shaped, checkered’. It seems worth while to attempt a more precise translation, and, if possible, to estimate the significance in context of the goods so designated. (shrink)

Contractarians aim to derive moral principles from the dictates of instrumental rationality alone. But it is well-known that contractarian moral theories struggle to identify normative principles that are both uniquely rational and morally compelling. Michael Moehler's recent book, *Minimal Morality* seeks to avoid these difficulties by developing a novel "two-level" social contract theory, which restricts the scope of contractarian morality to cases of deep and persistent moral disagreement. Yet Moehler remains ambitious, arguing that a restricted version of Kant's categorical imperative (...) is a uniquely rational principle of conflict resolution. We develop a formal model of Moehler's informal game-theoretic argument, which reconstructs a valid argument for Moehler's conclusion. This model, in turn, enables us to expose how a successful argument for Moehler's contractarian principle rests on assumptions that can only be justified by subtle yet significant departures from the standard conception of rationality. We thus extend our understanding of familiar contractarian difficulties by showing how they arise even if we restrict the scope of contractarian morality to a domain where its application seems both promising and necessary. We show that the problem lies not in contractarians' immodest ambitions but in the modest resources rationality can offer to satisfy them. (shrink)

Doctors’ strikes are legally permissible in the UK, with the situation differing in other countries. But are they morally permissible? Doug McConnell and Darren Mann have systematically attempted to dismiss the arguments for the moral impermissibility of doctors’ strikes and creatively attempted to provide further moral justification for them. Unfortunately for striking doctors, they fail to achieve this. Meanwhile, junior doctors’ strikes have continued in the UK through 2023 and have now extended into 2024. In this response, which focuses on (...) the UK situation and specifically junior doctors’ strikes in the National Health Service (NHS) in England, I will demonstrate a central problem with their arguments—namely that they underplay the harms caused by prolonged doctors’ strikes by ignoring the harms to patients with cancer. This weakens their conclusion that strikes are morally permissible in terms of the conditions and thresholds they set. I then provide a psychological critique of their justification for strikes in terms of the interests of the public. It follows that invoking the controversial concept of supererogatory action is ungrounded but also absurd when you consider time-critical cancer care. If those representing striking doctors wish to maintain a modicum of moral respectability, they should mitigate for patients with cancer and negotiate reasonably and with urgency. (shrink)

Despite Vancil’s (1979) proclamation over twenty years ago that topoi have been abandoned in argument theory, this essay contends that topoi should have a vital role in contemporary argumentation theory. Four key areas are identified where topoi are (or can be) essential tools for argumentation: Locating argument, building argument, development of critical thinking, and argument pedagogy. As a result, teachers and students of argument can both benefit from a (re)discovery of topoi.

The use of tensed language and the metaphor of set ‘formation’ found in informal descriptions of the iterative conception of set are seldom taken at all seriously. Both are eliminated in the nonmodal stage theories that formalise this account. To avoid the paradoxes, such accounts deny the Maximality thesis, the compelling thesis that any sets can form a set. This paper seeks to save the Maximality thesis by taking the tense more seriously than has been customary (although not literally). A (...) modal stage theory, MST, is developed in a bimodal language, governed by a tenselike logic. Such a language permits a very natural axiomatisation of the iterative conception, which upholds the Maximality thesis. It is argued that the modal approach is consonant with mathematical practice and a plausible metaphysics of sets and shown that MST interprets a natural extension of Zermelo set theory less the axiom of Infinity and, when extended with a further axiom concerning the extent of the hierarchy, interprets Zermelo–Fraenkel set theory. In The Construction of Social Reality, John Searle develops a theory of institutional facts and objects, of which money, borders and property are presented as prime examples. These objects are the result of us collectively intending certain natural objects to have a certain status, i.e. to ‘count as’ being certain social objects. This view renders such objects irreducible to natural objects. In this paper we propose a radically different approach that is more compatible with standard economic theory. We claim that (...) such institutional objects can be fully understood in terms of actions and incentives, and hence the Searlean apparatus solves a non-existent problem. (shrink)

Contemporary discussion concerning institutions focus on, and mostly accept, the Searlean view that institutional objects, i.e. money, borders and the like, exist in virtue of the fact that we collectively represent them as existing. A dissenting note has been sounded by Smit et al. (Econ Philos 27:1–22, 2011), who proposed the incentivized action view of institutional objects. On the incentivized action view, understanding a specific institution is a matter of understanding the specific actions that are associated with the institution and (...) how we are incentivized to perform these actions. In this paper we develop the incentivized action view by extending it to institutions like property, promises and complex financial organisations like companies. We also highlight exactly how the incentivized action view differs from the Searlean view, discuss the method appropriate to such study and discuss some of the virtues of the incentivized action view. What does being money consist in? We argue that something is money if, and only if, it is typically acquired in order to realise the reduction in transaction costs that accrues in virtue of agents coordinating on acquiring the same thing when deciding what thing to acquire in order to exchange. What kinds of things can be money? We argue against the common view that a variety of things (notes, coins, gold, cigarettes, etc.) can be money. All monetary systems are (...) best interpreted as implementing the same basic protocol. Money, i.e. the thing that we coordinate on acquiring in order to lower our transaction costs, is, in all cases, a set of positions on an abstract mathematical object, namely a relative ratio scale. The things that we ordinarily call ‘money’ are merely records of positions on such a scale. (shrink)

Neologicists have sought to ground mathematical knowledge in abstraction. One especially obstinate problem for this account is the bad company problem. The leading neologicist strategy for resolving this problem is to attempt to sift the good abstraction principles from the bad. This response faces a dilemma: the system of ‘good’ abstraction principles either falls foul of the Scylla of inconsistency or the Charybdis of being unable to recover a modest portion of Zermelo–Fraenkel set theory with its intended generality. Takeuti introduced an infinitary proof system for determinate logic and showed that for transitive models of Zermelo-Fraenkel set theory with the Axiom of Dependent Choice that contain all reals, the cut-elimination theorem is equivalent to the Axiom of Determinacy, and in particular contradicts the Axiom of Choice. We consider variants of Takeuti's theorem without assuming the failure of the Axiom of Choice. For instance, we show that if one removes atomic formulae of infinite arity from the language of Takeuti's proof (...) system, then cut elimination is equivalent to a determinacy hypothesis provable, e.g., in ZFC + “there are infinitely many Woodin cardinals.” A slight extension of the proof system admits cut elimination for countable sequents under the same assumptions. A simple modification of the proof system yields analogs of the results above for the Axiom of Real Determinacy and uncountably many Woodin cardinals. (shrink)

This chapter discusses author's view a Thomistic‐like dualism. Next, it lays out the details of his position and he argues that it has certain advantages over physicalist treatments of the human person, and, to a lesser degree, over alternate versions of substance dualism. Then, he responds to some objections against his position. Joseph Almog pointed out that Kripkean causal chains not only exist for names, but for all linguistic items (Almog 1984: 482). Based on this, he argues that the role of such chains is the presemantic one of assigning a linguistic meaning to the use of a name (1984: 484). This view is consistent with any number of theories about what such a linguistic meaning could be, and hence with very different views about the semantic reference of names. He concludes that (...) the causal theory is ‘rather trivial’ (1984: 487). In this paper I argue that Almog is correct to hold that the causal theory is trivial, but, contra Almog, argue that the triviality of the existence of causal chains is not a matter of such chains having a presemantic role in assigning linguistic meanings to utterances. Instead, such triviality is due to the fact that the causal theory reflects no more than a truism about the epistemology of convention acquisition. (shrink)

Not long ago, one of us has clarified and defended a bare particular theory of individuation. More recently, D. W. Mertz has raised a set of objections against this account and other accounts of bare particulars and proffered an alternative theory of individuation. He claims to have shown that 'the concept of bare particulars, and consequently substratum ontology that requires it, is untenable.' We disagree with this claim and believe there are adequate responses to the three arguments Mertz raises against (...) bare particulars. To substantiate this assertion, we clarify the nature of bare particulars as individuators, state Mertz's objections, and respond to them. We conclude that Mertz has failed to show that bare particular theory is untenable. (shrink)

The ‘decapitation gambit’ holds that, if physical decapitation normally entails the death of the human being, then physiological decapitation, evident in cases of total brain failure, entails the death of the human being. This argument has been challenged by Franklin Miller and Robert Truog, who argue that physical decapitation does not necessarily entail the death of human beings and that therefore, by analogy, artificially sustained human bodies with total brain failure are living human beings. They thus challenge the current neurological (...) criterion for determining death and argue for a return to the traditional criterion of the irreversible loss of circulation and respiration. During the months before and after he saw Julius Caesar assassinated on the Ides of March, 44 BC, Cicero wrote two philosophical dialogues about religion and theology: On the Nature of the Gods and On Divination. This book brings to life his portraits of Stoic and Epicurean theology, as well as the scepticism of the new Academy, his own school.
